Message from the Chairman

Last month we mentioned that the WV Export Council is developing a new website. We hope when finished, the site will be a gateway for West Virginia business success in the global economy. As a sneak preview this is our new look. The website is being developed jointly with our close allies and partners, the West Virginia Development Office and the U.S. Department of Commerce. Promote your Building Products in Mexico at Expo CIHAC 2004 in Mexico City - October 14-20, 2004

What is Expo CIHAC?
Expo CIHAC 16 th Annual Exhibition and Technical Presentations is the largest and most prestigious event in Mexico and Latin America for the building, construction and housing industry.

Federal Update

DEFENSE TRADE CONTROLS - The U.S. Department of State has responsibility for the control of the permanent and temporary export and temporary import of defense articles and services, as outlined under the Arms Export Control Act and International Traffic in Arms Regulations. As part of its control measures, the State Department's Directorate of Defense Trade Controls (DDTC) implemented an electronic licensing system, D-Trade, which can receive, review, and adjudicate defense export authorization requests. Submissions from are made via an encrypted Internet site. Users are provided software that enables them to complete the forms and attach supporting documents in softcopy. Users can track their license applications shortly after submission by either DDTC-assigned license numbers or industry-generated transaction numbers. License applications are electronically forwarded to appropriate offices for review. Since 1876, Hamilton Kettles, presently located in Weirton, has been serving a variety of industries with their superior quality kettles and process vessels. The products are custom engineered and assembled from a large stock of standard components to meet precise processing requirements.

All these products are fabricated of the highest quality materials and components. They're finished carefully inside and out for ease of cleaning and maximum heat transfer. Updated U.S. Export Controls for Syria and Libya

SYRIA - President Bush on Tuesday, May 11, 2004, banned all U.S. Exports to Syria except for Food and Medicine, ordering sanctions after long standing complaints that Syria was supporting terrorism and undermining U.S. efforts in Iraq. LIBYA - On April 23, the Department of the Treasury's Office of Foreign Assets Control (OFAC) issued General License 550.575, which transferred licensing jurisdiction for the export of items subject to the Export Administration Regulations (EAR) to the Bureau of Industry and Security (BIS). The effective date of this General License is April 29. OFAC continues to maintain certain financial restrictions, including blocking the assets of named persons. On April 29, BIS published an amendment:

http://www.bis.doc.gov/ to the EAR in the Federal Register. This amendment updates our license requirements for Libya. The amendment is consistent with changes in U.S. legal authorities concerning Libya and reflects Libya's continuing good faith effort to completely dismantle its weapons of mass destruction and missile programs, and adherence to its renunciation of terrorism. Items controlled by the multilateral export control regimes [i.e., items controlled for national security (NS), missile technology (MT), chemical and biological weapons (CB), and nuclear nonproliferation (NP) reasons on the Commerce Control List (15 CFR Part 774)(CCL)] require a license to Libya, as do items controlled for crime control (CC) and regional stability (RS) reasons.

Libya remains on the list of designated state sponsors of terrorism. As a result, most items controlled for anti-terrorism (AT) reasons will continue to require a license for export or re-export to Libya.

Additionally, certain categories of items controlled for reasons not included on the Country Chart in Part 738 of the EAR [e.g., encryption (EI), short supply (SS), Chemical Weapons (CW), Computers (XP) and Significant Items (SI)] also require a license for export or re-export to Libya.

KEEPING SHIPPER'S EXPORT DEC INFO CONFIDENTIAL - Recent news articles claim that a foreign government has been requesting a copy of the Shipper's Export Declaration (SED) for exports entering the country from the U.S. However, under provisions of the U.S. Foreign Trade Statistics Regulations, information on the SED may not be disclosed to anyone except the U.S. Principal Party in Interest or their agent, and only when such a copy is needed to comply with U.S. official legal and regulatory export control requirements. Therefore, U.S. firms should not provide a copy of the SED or Automated Export System record to other governments. Providing such information would be contrary to the U.S. Census Bureau/Foreign Trade Division's commitment to maintain confidentiality of information filed with them.
